Seeking an expert opinion for your employee
You might want to seek an expert opinion (‘deskundigenoordeel’) if you feel your employee’s return-to-work process is not going the way it should. Or if you have questions about your employee returning to work. Keep in mind that an expert opinion is not binding in any way.
- You want to check whether your employee can return to work on a certain date without adjusting their work hours or duties.
- You want to check whether your employee’s new role and/or modified duties are reflective of their current situation.
- You want to check your employee has made enough effort to return to work.
- You want to check you have done enough to support your employee’s return to work.
- You want an expert opinion on your employee’s excessive absenteeism.
To seek an expert opinion, complete the Seek an expert opinion for your employee form (‘Aanvragen deskundigenoordeel door werkgever’). You will need to log onto the employer portal with your EH3 level eHerkenning account to do this.
Keep in mind that you will need to use a separate form for each of the situations described above. So, if you want to seek an expert opinion on more than 1 situation, you will need to complete this form more than once.
- your payroll tax number (‘loonheffingennummer’)
- your employee’s citizen service number (BSN), date of birth, address and contact information
- your employee’s first day of absence due to illness
- your employee’s work hours per week according to their employment contract
- the date on which you stopped paying your employee’s salary (if applicable)
- the address and contact information of the occupational health and safety service (‘arbodienst’) or occupational health physician (‘bedrijfsarts’)
- the documents required for your specific situation (in Dutch)
It costs € 400 to seek an expert opinion. Keep in mind that you will need to pay this amount for each request you submit.
Please note: You will not have to pay for an expert opinion if you need to dismiss an employee for excessive absenteeism or for not following their return-to-work plan.
You will usually receive the expert opinion within 4 weeks.
We will send you and your employee a copy of the expert’s opinion. Your employee will also receive a copy of your request and any documents you submitted.
