Ukrainian employees must meet the following criteria to work in the Netherlands without a work permit:
- They must officially have been granted protection under the Temporary Protection Directive (‘Richtlijn Tijdelijke Bescherming’).
- They must have an employment contract.
Ukrainian employees must also at all times be able to prove they have been granted protection by presenting the following documents:
- a letter from the IND stating how long they can stay in the Netherlands for
- a sticker or ‘Type O immigration status document’ (‘O-document’) issued to them by the IND
Please note: Non-Ukrainians who had temporary or permanent residence in the Ukraine (third-country nationals) will also not require a work permit. They will receive a ‘Type O immigration status document’, which will specify the length of their permitted stay in the Netherlands.
Complete the Notification form for hiring Ukrainian employees under the Temporary Protection Directive (‘Melden tewerkstelling van een tijdelijk beschermde werknemer uit Oekraïne’). Then log onto the employer portal with your eHerkenning account. Once you are in the portal, click on ‘Tewerkstelling’ (‘Employment’) and then on ‘Melden/Wijzigingen’ (‘Notify/Change of circumstances’) to submit your form.
We will send you a letter confirming we have received your form. You will not have to wait for this letter in order for your employee to start working at your organisation. They will be allowed to do this 2 days after you have uploaded your form.
Check your employee has the following before they start working for you:
- a citizen service number (‘BSN’)
- a valid, current and authentic proof of identity
If you have any doubts about the authenticity of your employee’s proof of identity, call the Centre of Expertise on Identity Theft and Documentation (‘ECID’) on 0800 – 1814.
Employees arriving from Ukraine are entitled to the same rights as all other employees in the Netherlands. This includes the right to a safe work environment, appropriate breaks, holiday leave and the national minimum wage. If your organisation is governed by a collective labour agreement (‘CAO’), this will also extend to your Ukrainian employees.
All of the following changes must be reported to us:
- if your employee decides to leave their job
- if you renew your employee’s contract
- if your employee takes on a new role
To report these changes, complete the Change of circumstances form for Ukrainian employees who have been granted protection (‘Doorgeven wijziging bij tewerkstelling van een tijdelijk beschermde werknemer uit Oekraïne’). Then upload your completed form to the employer portal. To do this, follow the exact same process as outlined for uploading the ‘Notification form for hiring Ukrainian employees under the Temporary Protection Directive’.
